Secopx.com – Secopx LTD – General Terms of Service.

MUST READ AND ACCEPT BEFORE USING THE SOFTWARE OR PURCHASING A LICENSE!

Those Terms of service are applicable to ALL of the Secopx products and services BUT please be aware that that Intrusense Sensor (the secopx sensor) has a separate warning and terms of service (WARNING-MUST-READ-BEFORE-USE.TXT & LICENSE-AND-CREDITS.txt & warning.txt) please read, understand and accept those files before using the open source sensor.

BY USING,LOGIN,DOWNLOADING & INSTALLING ANY OF THE SECOPX.COM SOFTWARE, YOU ARE AGREEING TO BE BOUND WITH THE TERMS AS WRITTEN IN THIS LICENSE. THIS PRODUCT COMES WITH NO GUARANTEE, NO S.L.A (service layer agreement) or any kind of guarantee ,USE IT IS ON YOUR OWN RISK! IF YOU DO NOT AGREE TO ALL THE TERMS IN THIS LICENSE, THEN DO NOT USE,INSTALL OR DOWNLOAD OUR SOFTWARE!

Definitions:

this terms of service and license are refers only to the web version of the Secopx user interface aka “S.O.C/SIEM as a service”.

The sensor itself comes with it’s own license (GPL3) and has a separate license! (see credits.txt and licenses.txt and warning.txt at the /opt/Intrudia-v30/)

This license that you are reading now is the terms of service and license is for using the “SOC/SIEM as service” e.g the interface or the web interface of the “S.O.C/SIEM as a service”

  1. “Software means “code, both binary or source format which appear at our website secopx.com attached application and programs (including SMS/EMAIL sendings) and attached documentation or related texts , that are open source and owned by open source license as provided or referenced by the creator as appear in the license “credits.txt” file, the term “code” reference to both cases whether such materials are provided directly by Secopx or by 3rd party software provider or component.

Subject to the license below, Secopx hereby grants to You a royalty free, non-exclusive & non-transferable right under its copyrights to use it’s web system also known as ‘s.o.c as a service’ or “S.i.e.m as a service” as appeared in the website secopx.com and it’s sub domains for a limited time, this limited time is defined in the type of purchased license (6 month,1 year or vary)

  3. Warranty and Disclaimer. THIS SOFTWARE IS PROVIDED “AS IS”, IT MEANS IT COMES WITH ABSOLUTELY NO KIND OF WARRANTY! NO WARRANTY WHATSOEVER! EXPRESS OR Inferred, THIS INCLUDES NO WARRANTY FOR THE Inferred warranty OF MERCHANT-ABILITY AND NO INFRINGEMENT AND NO WARRANTY FOR A FITNESS FOR A PARTICULAR PURPOSE.

    You are responsible for choosing the right Software that allow you to achieve your intended goals, and for the use and understanding the results may obtained from the Software, computer security and understanding the following processes are complex and understanding theme correctly is a complex task that we can not give any guarantee that such a process will be always done correctly, mistakes may occur and we cannot guarantee that they will not occur both by a computer system (e.g the Secopx products) or by human errors (e.g the Secopx S.O.C as a service), by using this software and service you accept this and understand this!

Secopx makes no warranty that the software will be error-free or free from interruptions to your servers or computer systems,business flow or any possible failure or harm that might happen to your technical infrastructure, including servers, computers, and user data ,in general we do not guarantee that our software and service will meet your requirements or can do what it’s promise, every system including ours has bugs and vulnerabilities, known and unknowns, and we just takes no responsibility for any breach or problem you might have from using our product and service.
  5. NO LIABILITY! Whatsoever! By no means AND UNDER NO Lawful Hypothesis or theory, Regardless of whether IN VERBAL, Agreement, OR other, WILL SECOPX OR ITS Providers BE Subject TO YOU FOR ANY damage OF ANY Sort, WHETHER SUCH damage is direct or indirect or such damages ARE Ordered AS Immediate, Aberrant, Unique, Coincidental, OR Significant Harms, INCLUDING, WITHOUT Constraint, Harms FOR LOSS OF profits,data, OR Generosity, WORK STOPPAGE, server damage or stop of work,hardware damage, or software damages OR Breakdown, OR FOR Some other Harm OR Misfortune.

INDEMNIFICATION. You agree to hold and release Secopx and its employees,3rd party engineers, agents & officers from any case or indemnification, including lawyer’s expenses, made by any party outsider due to or emerging out of Your utilization of the Product in penetrate of this Understanding, or even in case of violation of a 3rd party.


High Risk Activities. Secopx products are NOT fault-tolerant and are not designed or intended for use in “mission critical” environments that requires fault tolerance aka “fail-safe performance”, this includes without any limitations, the operation of Hospitals, gas and oil facilities along with nuclear facilities, aircraft navigation systems & air traffic systems, RF or non RF communication systems, traffic control, weapons systems,

direct life-support machines, or some other application wherein the core failure of the Product could lead to a death of a person, individual injury, or other serious physical or property harm (any “High risk Exercises”). Secopx explicitly disclaims any express or implied guarantee of fitness for High risk activities.

Governing Law. This Agreement will be governed only under the Israeli law and will be discussed only in the courts of Tel Aviv, Israel.

Miscellaneous. This Agreement with all of its including documents weather incorporated by a reference or not by a reference, this document representing both parties of the agreement, this document is canceling & suppressing any other communication between the parties including oral or written!

This Agreement may not be modified except by a written addendum issued by a duly authorized representative of Secopx. No provision hereof shall be deemed waived unless such waiver shall be in writing and signed by Secopx. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

This Arrangement may not be edited or modified.

7. NO CYBER INSURANCE guarantee whatsoever. we are not a cyber insurance and not intended to be such or give such services,actually, you understand we give 0 guarantee of security to your servers, data and users and any electrical systems might be affected ,if you have “cyber insurance” policy by a 3rd party firm they MUST permit, in advanced prior to usage and in written form that they confirm your security infrastructure and security product.

8. NO GUARANTEE WHATSOEVER, we give NO guarantee, our products comes with no guarantee whatsoever, if you want full guarantee S.L.A

9.Data retention – we will save the user data such as log files with IP address and “user agent” such as browser type for up to 1 year. Regarding user data in the app itself such as “data retention” of user logs or user data, we do not guarantee to any S.L.A or any manner of saving your data, if data retention is important to you please contact us to make a custom S.L.A agreement that relates to SLA and data retention or any kind of saving customer data for more than the minimum time appear in our interfaces, the client must understand that by default data retention is NOT guaranteed and MUST be defined in a separate custom agreement, by default we do not give any guarantee for data retention, it’s the client obligation to keep his data on a 3rd party device or software.

10. Data Security,we keep all of our data safe on a secure server and we perform monthly penetration testings in order to secure our data, we currently does NOT comply any data security regulation such as PCI-DSS and ISO, please keep this in mind when using our services and products!

11) we Secopx.com hold the right to modify and change this T.O.S as we wish, we will update the T.O.S on our website secopx.com so please visit the site and read the T.O.S from time to time.

12) Export Regulations – Secopx is subject to regulation by Israeli,U.S & foreign governments and agencies, which may prohibit export of some technical components and information to some countries. You must comply with all export laws and restrictions applicable to the technology by your government.

13) NO GDPR COMPLIANCE – we thanks god not based in Europe and we have nothing to do with the G.D.P.R, if you want to have something similar to the “right to be forgotten” simply write us with the subject “GDPR” if you want to contact us regarding GPDR simply email us with the subject “GDPR”

14) you have the right to install such software on your hardware or virtual appliances.

15) Alerting liability or accuracy – part of our system is alerting, since we are using a 3rd party company for sending SMS and EMAILS we CANNOT guarantee that email or SMS will always arrive, yes, it is usually working, but as you know with I.T services, we can only hope, in many cases bugs appear or systems or computer do not work, doesn’t matter if it’s due to hardware failure or due to human failure, we simply CANNOT guarantee 100% or even 60% functioning, we can only try as a “good will” but cannot obligate or guarantee that.

16) Soc Analysis – As part of the “Soc/Siem as a service” which is an extra “paid” service Secopx LTD is offering, we offer the opinion of our team regarding security incidents that have happened in our clients servers/software/computers/mobiles, our experts will try to understand the security incident the client is facing via his logs that Secopx team has natural access to as part of the secopx system, the client MUST UNDERSTAND that this service is EXPERIMENTAL! It means we cannot really 100% understand the nature of your system and your complex web application via 1 or several support call, it means , we have NO obligation to supply you the client, a good 100% accurate solution to your secutiyu/devops/secops issue, it means also, we can only give you the direction we think you should act, but you the client, must understand that we at Secopx LTD have 0 responsibility toward the safety of your application or the way you will implement our theoretical idea for your servers or machine security.

Scope of such consultancy – you the client who bought the service of “Soc Siem as a service” from Secopx LTD, you fully understand that we are very very limited with our ability to really understand your request for help with a security solution you are facing via a 1 or many requests,

such forensics investigations can take days of not weeks of investigations AND CANNOT BE DONE within the scope of remote support request via the “Soc Analysis”, this specific service (soc analysis) is only for getting “first help” and better understand the nature of the attack you the client is facing.

Again, this service is just in order to give the user the “first aid” support regarding his security incident, Secopx LTD has NO obligation that the offered direction by her staff is the right solution

for the problem the client is facing, the client is obligated to hire 3rd party security experts in order to fully investigate the security incidents of his systems.
